A non-refundable retainer in the amount of 50% of the total cost is due and required upon signing of this contract to guarantee a date. Any remaining balance is due no later than 30 days prior to the Client's event. Checks & credit card are acceptable forms of payment.

Snap! PhotoBooth will add a $50.00 fee for any and all returned checks written for PhotoBooth rentals.
ADDITIONAL OPERATING TIME
If the operator uses the equipment for a time period in excess of the service period agreed to in the invoice, overages will be billed at the rate of $175.00 per hour on day of event. Payment for any overage in time must be paid before additional hours are provided and may only be made by credit card.
ACCESS, SPACE & POWER FOR PHOTO BOOTH
Client will arrange for the venue to be accessible at least an hour prior to contracted start time. Client will arrange for appropriate space for the Photo Booth at event's venue. (5' deep x 5' wide x 7.5' high) Client is responsible for providing access to power for the PhotoBooth. (110v, 10 amps, 3-prong outlet located no further than 15 feet from Photo Booth location). Snap! PhotoBooth will take every precaution not to cause damage, but will not be responsible for any ruts or damage to a lawn or flooring at the event location. Site for the Photo Booth must be level and dry.
DATE CHANGES & CANCELLATIONS
Any request for a date change must be made in writing at least 30 days in advance of the original event date. Change is subject to Photo Booth availability and receipt of a new Service Contract (A $50.00 change of date fee may apply). If there is no availability for the alternate date, the deposit shall be forfeited and event cancelled. Any cancellation occurring less than thirty days prior to the event date shall forfeit all payments received. Cancellations made prior to 30 days will forfeit their 50% deposit retainer.
DAMAGE TO PROVIDER'S EQUIPMENT
Client acknowledges that he or she is responsible for any damage or loss to the Provider's Equipment caused by: 1) Any misuse of the Provider's Equipment by Client or its guests. 2) Any theft of Provider's Equipment or accessories. Client agrees to pay $8200.00USD for any damage beyond repair caused by client or guests. Any other damages will be billed to client at full retail price of equipment.
Client will indemnify Provider against any and all liability associated with the use of pictures taken within the Photo Booth its representatives, employees or affiliates at Client's Event.
EXCESSIVE HORSEPLAY OR THREAT
In the event of circumstances deemed to present a threat or implied threat of injury or harm to Snap! PhotoBooth Staff or any equipment, Snap! PhotoBooth reserves the right to cease service. If the Client is able to resolve the threatening situation in a reasonable amount of time, Snap! PhotoBooth shall resume performance in accordance with the original terms of this agreement. Snap! PhotoBooth will not be responsible for any refunds, regardless of how the situation is resolved or whether Snap! PhotoBooth resumes performance. In order to prevent equipment damage or liability arising from accidental injury to any individual attending this event, Snap! PhotoBooth and its representatives reserve the right to deny any guest access to the Photo Booth.
Client agrees to, and understands the following: All guests using the photo booth hereby give Snap!Photo Booth the right and permission to copyright and use, photographic portraits or pictures of any photo booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. In addition I, hereby release, discharge and agree to save harmless Snap! PhotoBooth, from any liability, that may occur or be produced thereof, including without limitation any claims for libel or invasion of privacy.
If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between Provider and Client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, Client agrees to solve any arguments via arbitration. In the event Provider is unable to supply a working photo booth for at least 80% of the Service Period, Client shall be refunded a prorated amount based on the amount of service received. If the printer fails to print out photos on site the Provider will be allowed to give a web site to the client where there guests can log onto and download the digital files for their own personal use.
Snap! PhotoBooth reserves the right to reject any rental order or client at any time for any reason at its discretion. Any monies paid will be refunded and Lessee may not at any time afterward sue for damages.
